CONDITIONS OF ENTRY
WIN A BROTHER HELPING HAND FOR A YEAR PROMOTION
- 1. Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant. Entry is via the Internet only.
- 2. Entry is open to residents of Australia aged 18 years or older who purchase any Brother® P-Touch Electronic Labeller or QL Label Printer from a participating retailer in Australia during the promotional period (“Eligible Purchase”). The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies associated with this promotion are ineligible to enter the promotion.
- 3. To enter the promotion, eligible entrants must make an Eligible Purchase and then complete and submit the online entry form at www.winbrotherhelpinghand.com.au (“Promotional Website”) during the promotional period. Payment of the Eligible Purchase must be made in full. Lay-Bys and pre-orders will not be accepted. In order to fully complete their entry, eligible entrants will be required to enter their full name, age, gender, residential address, contact telephone number, mobile telephone number (if applicable), current and valid email address, date of Eligible Purchase, the product serial number, and the store receipt number for the Eligible Purchase. Original store receipts must be retained for entrants to be eligible.
- 4. Promotion commences at 12:01am (AEDT) on 1/11/2009 and closes at midnight (AEDT) on 28/2/2010. The prize draw will take place on 31/3/2010 at 11:00am (AEDT) at Anisimoff Legal – Advertising Marketing & Media Lawyers, Suite 1, Level 1, 34 Chandos Street, St Leonards NSW 2065. All winners will be notified by telephone and in writing (mail or email) and their names and localities will be published in The Australian on 6/4/2010. All reasonable steps to notify winners will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.
- 5. Any costs associated with accessing the Promotional Website remain the responsibility of each entrant and are dependent on the Internet service provider used. Any contact details entered incorrectly on the Promotional Website shall be deemed invalid and will result in an ineligible entry.
- 6. Only one (1) entry per household. Any subsequent entry after the first entry is received from a household will be deemed invalid. For the avoidance of doubt, a household is determined by the residential address submitted by an entrant in their entry. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. Entries must be received during the promotional period. Internet entries will be deemed to be accepted at the time of receipt and not at the time of transmission.
- 7. The first three (3) eligible entries randomly drawn from all eligible entries received will each win monthly ‘live-out’ domestic housekeeping, gardening and home maintenance and handyman assistance (an average of up to three (3) hours per month, which ideally should be used each month but may be rolled over with the consent of the Promoter) from DIAL-AN-ANGEL® during a continuous period of one (1) calendar year (starting from the date when a winner claims a prize), each valued at up to $2,778.00. DIAL-AN-ANGEL® services are subject to prevailing DIAL-AN-ANGEL® terms and conditions. A prize can be used in any type of dwelling, including but not limited to a stand-alone building or an apartment, subject to any applicable local council, strata or body corporate approval (to the satisfaction of the Promoter). If a winner is a tenant of a rental property, they must first obtain written permission, to the satisfaction of the Promoter, from their landlord or landlord’s real estate agent in order to accept the prize. A prize may only be claimed for use at the ordinary residence of a winner as set out in their entry. Winners must provide DIAL-AN-ANGEL® with the products and equipment necessary to carry out the services provided in a prize. If the winner is unable to provide DIAL-AN-ANGEL® with the required products or equipment to carry out their services, they can request DIAL-AN-ANGEL® to provide these at an additional fee (at the winner’s cost and is not included in the prize), as outlined in the prevailing terms and conditions of DIAL-AN-ANGEL®.
- 8. The Promoter recommends that all entrants review the DIAL-AN-ANGEL® terms and conditions prior to entry in the promotion.
- 9. The prize is:
- a. general domestic housekeeping, which may include:
- i. washing and ironing of clothing apparel;
- ii. changing and laundering of bed linen;
- iii. bed-making;
- iv. preparation, cooking and service of basic family meals (using food provided by the winner); and
- v. shopping for household provisions (using the winner’s money);
- vi. walking, washing and feeding pets; and
- vii. driving children to and from school (using the winner’s car);
- b. general garden and outdoor maintenance and handyman services, which may include:
- i. hosing garden paths;
- ii. cleaning outside windows;
- iii. touch-up painting;
- iv. lawn-mowing;
- v. tidying up gardens and other general garden maintenance;
- vi. car-washing; and
- vii. pool care and maintenance; and
- c. general home maintenance and handyman services, which may include:
- i. cleaning the stove hot plates;
- ii. cleaning the oven;
- iii. cleaning the refrigerator and freezer;
- iv. replacing tap washers;
- v. replacing light globes;
- vi. minor carpentry repairs; and
- vii. touch-up painting.
- 10. DIAL-AN-ANGEL® will work with the winner in respect of services to be carried out in fulfilling their prize. A prize may only be claimed Monday to Sunday of each applicable month with three (3) hours minimum call-out notice for housekeeping services and two (2) hours minimum call-out notice for home and outdoor/gardening maintenance and handyman services. Bookings made outside of normal weekday business hours (for the avoidance of doubt, Monday to Friday 5:00pm – 8:30pm) and Saturdays, Sundays and public holidays (for the avoidance of doubt, 8:30am – 8:30pm) will attract a loading of $22.00 per booking. This additional booking cost is the responsibility of the winners and is not included in the prize.
- 11. As a condition of accepting a prize, a winner must sign any legal documentation as and in the form required by the Promoter and/or DIAL-AN-ANGEL® in their absolute discretion, including but not limited to a legal release and indemnity form.
- 12. If a winner’s ordinary residential address is in Tasmania or Northern Territory, or not in a metropolitan area of a major capital city and/or within a reasonable distance of a DIAL-AN-ANGEL® office, then the Promoter may, in its sole discretion, elect to award the winner’s prize in cash in lieu of the services. The cash prize will be made payable by cheque in the winner’s name.
- 13. Taking a prize is subject to any prevailing terms and conditions of DIAL-AN-ANGEL®, and as such any dispute or issue that may arise in respect of use of a prize must be directed to the prize supplier, DIAL-AN-ANGEL® and not the Promoter.
- 14. If a prize or part thereof becomes unavailable for any reason beyond the Promoter’s reasonable control, then a similar prize or part thereof of equal or greater value will be awarded to the winners in lieu, subject to any written directions made under applicable State or Territory legislation.
- 15. The total maximum prize value is up to $8,334.00. Prize value is Recommended Retail Price including GST. A prize is not transferable or exchangeable and cannot be taken as cash (unless otherwise specified) or at multiple locations. A prize must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any variation in prize value. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
- 16. Entrants must retain, and may be required to present, an original receipt of their Eligible Purchase as proof of purchase and to confirm their eligibility to be awarded a prize. A failure to provide proof of purchase for an entry may, at the discretion of the Promoter, result in that entry submitted by an entrant being deemed invalid. The Promoter reserves the right to verify an entry with the retailer that issued the relevant purchase receipt. An entrant must submit proof of purchase documentation to the Promoter by mailing in one (1) stamped envelope, a photocopy of their original store receipt, to: Brother International – Win A Brother Helping Hand For A Year Promotion, PO Box 398, North Ryde NSW 1670. If any of the details submitted as part of the proof of purchase documentation do not match the online entry details submitted by the entrant and received by the Promoter, the entry will be deemed invalid.
- 17. Entrants can only enter in their own name. The Promoter reserves the right to request an entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the entrant’s identity, age, residential address and email address, eligibility to enter and claim a prize (including written permission from a winner’s landlord or landlord’s real estate agent (as applicable), local council, strata or body corporate, if applicable) and any information submitted by the entrant in entering the promotion, before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the entrant or entry has not been verified or validated to the Promoter’s satisfaction within the time requested, that entry will be deemed invalid. A prize will only be awarded following any validation and verification that the Promoter requires in its sole discretion.
- 18. The Promoter may conduct such further draws at the same time and place as the original draw as are necessary on 1/7/2010 in order to distribute any prize unclaimed by that date subject to any written directions given under applicable State or Territory legislation. Any winner in any unclaimed prize draw will be notified by telephone and mail or email and their name and locality will be published in The Australian on 7/7/2010.
- 19. The Promoter and its associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with using any prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
- 20. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for: (a) tampering with the entry process; or (b) for submitting an entry which is not in accordance with these Conditions of Entry; or (c) if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
- 21. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including without limitation technical malfunctions or failures.
- 22. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
- 23. Caution: Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Promotional Website or the information on the Promotional Website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Conditions of Entry or any other legal obligation by an entrant, the entrant agrees to indemnify the promoter for those losses, damages and costs.
- 24. The Promoter is not responsible for any problems, delays or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's computer or peripherals related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
- 25. If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions made under applicable State or Territory legislation.
- 26. As a condition of entering this promotion, an entrant consents to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. The entrant agrees that, in the event they are a winner, the entrant will participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.
- 27. An entry and any copyright subsisting in an entry irrevocably becomes, at the time of entry, the property of the Promoter. The Promoter collects personal information about an entrant to include the entrant in the promotion and where appropriate award prizes; and may, for these purposes, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. If the personal information requested is not provided, the entrant cannot participate in the promotion. By participating in the promotion, an entrant also acknowledges that a further primary purpose for collection of the entrant’s personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact the entrant in the future with information on special offers or provide the entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its Australian related companies or promotional partners who may contact the entrant with special offers in this way. By entering the promotion, an entrant agrees that the Promoter may use the entrant’s personal information in the manner set out in this condition. An entrant also agrees that the Promoter may publish or cause to be published a winner’s name and locality in any media as required under the relevant State or Territory lottery legislation. Entrants can also gain access to, update or correct any personal information by contacting the Promoter at the address below. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
